Welcome to GardenForGood.org (the “Website”), the website of Old School Produce Partners, Inc. (“OSPP,” “we,” “us,” or “our”).

These Terms & Conditions (“Terms”) govern your access to and use of this Website. By accessing or using the Website, you agree to these Terms. If you do not agree with these Terms, please do not use the Website.

1. About Old School Produce Partners

Old School Produce Partners, Inc. is a nonprofit organization based in Vinton, Iowa. Our mission is to bring volunteers together to grow fresh produce and provide it at no cost to local food pantries and the communities they serve.

The Website provides information about our organization, programs, volunteer opportunities, community activities, donations, partners, and related topics.

2. Use of the Website

You may use this Website for lawful, personal, informational, and noncommercial purposes.

You agree not to:

  • use the Website for any unlawful or fraudulent purpose;
  • interfere with or disrupt the operation or security of the Website;
  • attempt to gain unauthorized access to the Website, its servers, accounts, or related systems;
  • use automated systems, bots, scrapers, or similar methods in a manner that places an unreasonable burden on the Website;
  • introduce viruses, malicious code, or other harmful technology;
  • impersonate another person or misrepresent your affiliation with an organization; or
  • use Website content in a way that infringes the rights of OSPP or any third party.

We may restrict or terminate access to the Website when we reasonably believe these Terms have been violated or when necessary to protect the Website, OSPP, or others.

3. Website Information

We work to keep the information on this Website useful, accurate, and current. However, nonprofit activities, volunteer schedules, events, garden conditions, partner relationships, programs, statistics, and other information may change.

We do not guarantee that all Website content will always be complete, current, accurate, or available.

Information on this Website is provided for general informational purposes and should not be considered legal, financial, medical, tax, agricultural, or other professional advice.

4. Volunteer Opportunities

The Website may allow you to learn about volunteer opportunities or submit information indicating that you would like to volunteer.

Submitting a volunteer form or contacting OSPP does not guarantee a particular volunteer opportunity, schedule, assignment, or placement.

Volunteer activities may involve gardening, lifting, tools, outdoor conditions, uneven surfaces, heat, sun exposure, insects, vehicles, equipment, and other risks normally associated with garden and community-service activities.

Volunteers are expected to follow instructions, safety requirements, and policies provided by OSPP while participating in activities.

Participation in certain volunteer activities, events, or programs may also be subject to additional forms, policies, permissions, releases, or waivers. Those requirements are separate from these Website Terms.

Youth volunteers may be subject to additional parental, guardian, school, or organizational permission requirements.

Submitting a volunteer inquiry or performing volunteer service does not create an employment relationship between you and OSPP.

5. Donations

The Website may provide opportunities to make charitable donations to Old School Produce Partners, Inc.

Unless otherwise stated, donations support OSPP’s charitable mission and operating needs, including expenses associated with growing, maintaining, harvesting, and distributing fresh produce.

OSPP is recognized as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code. Contributions may be tax-deductible to the extent permitted by applicable law. You should consult your own tax advisor regarding the tax treatment of any contribution.

Unless otherwise stated in a donation receipt or fundraising offer, no goods or services are provided in exchange for a charitable contribution.

Donation Processing

Online donations may be processed through third-party payment providers. Your use of those services may also be subject to the payment provider’s own terms, conditions, and privacy practices.

OSPP is not responsible for the availability, security, or independent practices of a third-party payment provider, except to the extent required by applicable law.

Refunds and Donation Errors

Donations are generally considered final once processed.

If you believe a donation was made in error, submitted more than once, processed for an incorrect amount, or otherwise requires correction, please contact us promptly. Refund and correction requests will be reviewed individually and handled as appropriate and as permitted by law.

Designated and Restricted Gifts

Unless Old School Produce Partners, Inc. expressly agrees otherwise in writing, donations are made for the general charitable purposes of the organization.

Any preference, designation, comment, note, or requested use submitted with a donation will be considered when reasonably possible but does not create a legally binding restriction on the gift unless OSPP expressly accepts that restriction.

If a donation is made in response to a specific fundraising campaign, OSPP intends to use those funds in support of the stated purpose of that campaign. If the stated purpose is completed, becomes impracticable, no longer requires additional funds, or circumstances otherwise materially change, OSPP may use remaining funds for another purpose consistent with its charitable mission, to the extent permitted by applicable law.

Recurring Donations

If recurring donations are offered, recurring contributions will continue at the frequency and amount selected by the donor until canceled.

Recurring donations may generally be canceled through the applicable payment provider or by contacting OSPP, subject to the payment provider’s processing procedures and timing.

Cancellation of a recurring donation will apply to future charges and will not ordinarily reverse donations that have already been processed.

6. Forms and Communications

When you submit information through a volunteer form, contact form, donation form, newsletter signup, or another Website feature, you agree to provide information that is accurate to the best of your knowledge.

Submitting a form does not obligate OSPP to provide services, accept a volunteer, establish a partnership, respond to a request, or take any particular action.

If you provide contact information and request information from us, you authorize us to contact you as reasonably necessary to respond to your request or administer the activity for which you provided the information.

Our collection and use of personal information is also governed by our Privacy Policy.

7. Intellectual Property

Unless otherwise indicated, the Website and its contents—including the Old School Produce Partners name and logos, graphics, illustrations, photographs, written content, design elements, and other materials—are owned by or licensed to Old School Produce Partners, Inc. and are protected by applicable intellectual property laws.

You may view, print, or share reasonable portions of Website content for personal, educational, charitable, or other noncommercial purposes, provided that you do not materially alter the content or falsely suggest that OSPP endorses another organization, product, service, or cause.

You may not reproduce, sell, license, commercially exploit, or create misleading derivative uses of OSPP’s names, logos, branding, photographs, illustrations, or Website content without permission.

Nothing in these Terms grants you ownership of any OSPP intellectual property.

8. Third-Party Websites and Services

The Website may contain links to websites, services, social media platforms, payment processors, community organizations, food pantries, government resources, or other third parties.

These third parties operate independently from OSPP. We do not control their websites, content, security, availability, terms, or privacy practices.

A link from our Website does not necessarily mean that OSPP sponsors, endorses, or guarantees the third party or its products, services, or information.

You access third-party websites and services at your own discretion.

9. Photographs and Community Content

The Website may include photographs, testimonials, stories, or other materials relating to volunteers, community members, partner organizations, events, or OSPP activities.

Such materials are provided to communicate OSPP’s charitable mission and community impact.

If you believe an image, quotation, or other material involving you has been posted improperly or should be reviewed, please contact us.

10. Website Availability and Security

We may modify, update, suspend, or discontinue any portion of the Website at any time.

Although we take reasonable steps to operate and protect the Website, we cannot guarantee that the Website will always be uninterrupted, error-free, secure, or free from viruses or other harmful components.

You are responsible for using reasonable security precautions when accessing websites and online services.

11. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website and its content are provided “as is” and “as available.”

OSPP makes no express or implied warranties regarding the Website, including warranties concerning availability, accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or non-infringement.

Nothing in these Terms excludes any warranty or right that cannot legally be excluded under applicable law.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Old School Produce Partners, Inc. and its directors, officers, volunteers, representatives, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your access to or use of, or inability to access or use, the Website.

This limitation applies only to Website use and does not attempt to limit liability that cannot lawfully be limited or excluded.

Nothing in these Terms is intended to replace or modify any separate agreement, release, waiver, insurance coverage, or legal obligation relating to participation in an OSPP volunteer activity or event.

13. Responsibility for Misuse of the Website

You are responsible for losses, claims, or expenses reasonably resulting from your unlawful use of the Website, your intentional violation of these Terms, or your infringement of the rights of another person.

This provision does not require you to assume responsibility for conduct or circumstances for which applicable law does not permit responsibility to be imposed.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Website, our activities, applicable law, or our practices.

When we make changes, we will update the “Last Updated” date at the top of this page.

Your continued use of the Website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

15. Governing Law

These Terms and your use of the Website are governed by the laws of the State of Iowa, without regard to conflict-of-law principles.

Any dispute arising from these Terms or use of the Website will be handled in an appropriate state or federal court with jurisdiction in Iowa, unless applicable law requires otherwise.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where possible. The remaining provisions will continue in effect.

17. No Waiver

If OSPP does not immediately enforce a provision of these Terms, that does not waive our right to enforce that provision later.
